{"id":398,"date":"2025-10-22T11:05:11","date_gmt":"2025-10-22T09:05:11","guid":{"rendered":"https:\/\/cannabisante.org\/?p=398"},"modified":"2025-10-22T11:05:11","modified_gmt":"2025-10-22T09:05:11","slug":"acces-aux-medicaments-de-cannabis-ou-en-sommes-nous","status":"publish","type":"post","link":"https:\/\/cannabisante.org\/index.php\/2025\/10\/22\/acces-aux-medicaments-de-cannabis-ou-en-sommes-nous\/","title":{"rendered":"Acc\u00e8s aux m\u00e9dicaments de cannabis, o\u00f9 en sommes-nous\u00a0?"},"content":{"rendered":"\n<p>Octobre 2025<\/p>\n\n\n\n<p><strong>En mars 2025, avec la notification des textes \u00e0 la Commission europ\u00e9enne, le Gouvernement a engag\u00e9 la premi\u00e8re \u00e9tape pour permettre une entr\u00e9e dans le droit commun du cannabis \u00e0 usage m\u00e9dical. Le minist\u00e8re charg\u00e9 de la sant\u00e9 et de l&rsquo;acc\u00e8s aux soins avait r\u00e9affirm\u00e9 son engagement \u00e0 soutenir les patients concern\u00e9s durant cette p\u00e9riode de transition en restant pleinement mobilis\u00e9 pour suivre les avanc\u00e9es scientifiques et cliniques li\u00e9es \u00e0 l&rsquo;usage m\u00e9dical du cannabis.<\/strong><\/p>\n\n\n\n<p>Le Gouvernement partage l&rsquo;objectif d&rsquo;assurer un acc\u00e8s s\u00e9curis\u00e9 et encadr\u00e9 au cannabis \u00e0 usage m\u00e9dical pour les patients sans alternative de traitement. Ainsi, et conform\u00e9ment aux dispositions de la loi de financement de la s\u00e9curit\u00e9 sociale pour 2024, les m\u00e9dicaments \u00e0 base de cannabis seront soumis \u00e0 une autorisation d&rsquo;une dur\u00e9e de cinq ans, renouvelable par p\u00e9riode de cinq ans, d\u00e9livr\u00e9e par l&rsquo;Agence nationale de s\u00e9curit\u00e9 du m\u00e9dicament et des produits de sant\u00e9 (ANSM). \u00c0 l&rsquo;instar du dispositif exp\u00e9rimental, l&rsquo;acc\u00e8s au cannabis \u00e0 usage m\u00e9dical sera strictement restreint en derni\u00e8re ligne de traitement, sur prescription hospitali\u00e8re initiale, dans des indications et situations cliniques pour lesquelles l&rsquo;efficacit\u00e9 est pr\u00e9sum\u00e9e selon l&rsquo;ANSM. Les textes r\u00e9glementaires encadrant ce dispositif ont \u00e9t\u00e9 notifi\u00e9s \u00e0 la Commission europ\u00e9enne le 19 mars 2025, ouvrant une p\u00e9riode de statu quo de trois mois durant laquelle la Commission et les \u00c9tats membres ont pu les examiner. En l&rsquo;absence d&rsquo;objections majeures, ces textes, apr\u00e8s leur examen par le Conseil d&rsquo;Etat, auraient pu ainsi \u00eatre publi\u00e9s \u00e0 partir de fin juillet 2025.<\/p>\n\n\n\n<p>Parall\u00e8lement, la Haute autorit\u00e9 de sant\u00e9 (HAS) a \u00e9t\u00e9 charg\u00e9e en mars 2025 d&rsquo;\u00e9valuer l&rsquo;int\u00e9r\u00eat th\u00e9rapeutique du cannabis \u00e0 usage m\u00e9dical. Son avis, attendu \u00e0 la fin du premier trimestre 2026, conditionnera l&rsquo;\u00e9ventuelle prise en charge, c&rsquo;est-\u00e0-dire le remboursement ou non, ainsi que le taux de remboursement le cas \u00e9ch\u00e9ant de ces m\u00e9dicaments par l&rsquo;Assurance maladie.<\/p>\n\n\n\n<p>Dans l&rsquo;attente de l&rsquo;aboutissement des travaux de la HAS, le minist\u00e8re charg\u00e9 de la sant\u00e9 et de l&rsquo;acc\u00e8s aux soins a d\u00e9cid\u00e9 de prolonger la prise en charge du cannabis m\u00e9dical pour les patients encore sous traitement depuis la fin de l&rsquo;exp\u00e9rimentation, au-del\u00e0 du 31 d\u00e9cembre 2024. L&rsquo;objectif est de ne pas interrompre brutalement leur traitement par cannabis \u00e0 usage m\u00e9dical, pour des raisons de sant\u00e9 publique. Ainsi, jusqu&rsquo;au 31 mars 2026, la prise en charge des patients inclus dans l&rsquo;exp\u00e9rimentation sera assur\u00e9e \u00e0 titre exceptionnel pour les m\u00e9dicaments ayant \u00e9t\u00e9 autoris\u00e9s au titre de l&rsquo;exp\u00e9rimentation et factur\u00e9s par les pharmaciens d&rsquo;officine et de pharmacie \u00e0 usage int\u00e9rieur. Cette d\u00e9cision permettra \u00e9galement aux autorit\u00e9s sanitaires, notamment la HAS, de finaliser leurs travaux d&rsquo;\u00e9valuation. La HAS avait publi\u00e9 en juillet dernier sa m\u00e9thodologie de travail et le type de production<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>.<\/p>\n\n\n\n<p>Il est rappel\u00e9 que&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les avis de la CT ont vocation \u00e0 \u00e9clairer le bien-fond\u00e9 de la prise en charge d\u2019un m\u00e9dicament, sont destin\u00e9s au d\u00e9cideur public<\/li>\n\n\n\n<li>la d\u00e9cision de remboursement et ses modalit\u00e9s de prise en charge appartiennent aux ministres par voie de d\u00e9cret.<\/li>\n<\/ul>\n\n\n\n<p>A l\u2019heure de l\u2019examen du PLFSS 2026, les malades et professionnels de sant\u00e9 sont mobilis\u00e9s et contribuent activement via leurs travaux aupr\u00e8s de la HAS, les industriels du secteur constituent au mieux leurs dossiers d\u2019Autorisation d\u2019utilisation pour une p\u00e9riode temporaire (AUT). Il n\u2019en demeure pas moins que des interrogations fortes subsistent quant \u00e0 l\u2019aboutissement des textes d\u2019application de l\u2019article 78 de la LFSS 2024. Ainsi, des modifications juridiques sont attendues pour permettre concr\u00e8tement l\u2019entr\u00e9e du cannabis m\u00e9dical dans le droit commun, dans le syst\u00e8me hospitalier et en ville pour ainsi garantir un acc\u00e8s aux traitements sur tout le territoire pour tous les patients \u00e9ligibles.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><a
